Nitrogen emission allowance

The ruling of the Council of State of 5 April 2023 – that the distance at which the nitrogen deposits of a project need to be calculated may be limited to 25 kilometres – means there is a certain nitrogen emission allowance in Delfzijl and Eemshaven.

This nitrogen emission allowance enables businesses to invest in innovative and sustainable port development with a focus on the future. Eemshaven and Delfzijl are at more than 25 kilometres from overloaded Natura-2000 areas, which means this judgment does not impose nitrogen restrictions on developing the port and industrial areas. It is also important because this development is crucial to the energy transition and achieving climate targets.
